Privacy Policy

The following describes how The Brain Education ("Brain") deals with personal information collected through its websites.

Personal information collected by Brain is handled in accordance with the Privacy and Personal Information Protection Act 1998.

Brain's websites automatically collects personal information about you when you are using the website. Brain also explicitly collects personal information through its interactions with you - for example, applying for places or jobs, enrolling, completing a survey etc.

Collection of information automatically logged

Automated collection of information - Brain may collect personal information and other data about you from your computer as you browse or otherwise interact with our websites. The various mechanisms used include server logs, proxy logs, and cookies.

Cookies - A cookie is a package of data which a website requests be stored temporarily on your computer (or in memory) to identify you as a visitor to that website. You can choose to disallow cookies by changing settings on your web browser. However, if you reject all cookies you may not be able to use some of Brain’s websites.

The information collected by these various mechanisms includes:

  • he IP (Internet Protocol) address of the machine which has accessed the website;
  • the dates and times of each interaction on the website;r
  • the pages accessed and documents downloaded
  • sometimes, the previous site visited and the type of the browser used
Cookies may also store the following information: session (numbered key) and duration. A numbered key is a unique server-generated number used to identify the current session. The session key can be linked back to a user’s login identification.

Brain uses the data collected for statistical and business purposes such as diagnosing a fault, improving our services or when required to, for investigations. The data is not accessible except by authorised staff. Information which is automatically collected may be published as aggregated (de-identified) information to assist with improving the services offered by Brain through the website.

Storage and security of information

Information automatically collected by Brain through our websites is held primarily but not only by our system. Brain also uses the services of third party service providers who store information in their systems.

Brain has in place security measures based on a risk assessment process to protect against the loss, misuse, and alteration of the information. Brain also encrypts some information and transactions.

Use and disclosure

Information collected by Brain through automated mechanisms will only be used for the purpose for which it was collected in accord with this Privacy Statement.

Brain will not disclose this information concerning you to parties outside Brain except with your consent, or where required or authorised by law.

Personal information collected through Brain's websites and which is no longer required by Brain, nor required by law to be retained, will be destroyed, as authorised by the disposal authorities issued under the NSW State Records Act 1998.

Access to and correction of personal information

Breaches of security of Brain systems

Terms and Conditions

Online payment

It is your responsibility to ensure that:

  1. Sufficient cleared funds are in the account when the payments are drawn;
  2. The authorization to debit the account is in the same name as the account signing instruction held by the Financial Institution;
  3. Suitable arrangements are made if the direct debit is cancelled for any reason.

For declined transactions, the follow procedures apply:

  1. We treat the payment as if it was never recorded;
  2. Services may be suspended until outstanding charges are paid;
  3. A $55 dishonour fee may be applied to each transaction to cover additional administrative costs required to follow up the declined transaction and bank charges imposed on the Brain;
  4. Without further notification, we will attempt to debit your account every 5 working days;
  5. After 3 attempts to debit your account, if it is still unsuccessful, the matter may be referred to an external debt collector and may incur additional charges to you;
  6. Enrolment is not secured.

All customer records and account details are kept private and confidential to be disclosed only at your request or at the request of the Financial Institution in connection with a claim made to correct/investigate an alleged incorrect or wrongful debit or otherwise as required by law.

Parent and Student Agreement

1. Enrolment and Term Fees

At the time of enrolment, a one off enrolment fee of $55 (GST inclusive) applies. Term fees for the following term are due in the final week of the prior term. Online payment acts as a tentative confirmation of enrolment. If the online invoice has been incorrectly charged, The Brain reserves the right to invoice the remainder in order to secure enrolment.

2. Attendance

Students are expected to attend all the sessions in which they are enrolled. If any student fails to attend one or more lessons during their scheduled study period, we will not offer credits or refunds for the missed classes. If any student is unable to attend any scheduled class, we ask that parents contact us prior to the lesson (at least 24 hours notice) to support our duty of care.

3. Homework Policy

Students are requested to submit their homework by the due date in order to consolidate the students' understanding of concepts taught in class. Partially completed homework is deemed 'incomplete' and will be returned to students for completion and re-submission. If a student is experiencing difficulties completing his/her homework, he/she will be invited to attend our Workshop to resolve any learning shortfalls.

Ongoing non-completion of homework will result in direct contact with the parent/guardian by Brain academic staff.

When homework is submitted by the due date, it will be marked with appropriate feedback and returned weekly. Students may be invited to attend a Workshop when they require additional assistance.

4. Behavior

Students are expected to be on their best behaviour at all times, and must be dressed neatly whilst on Brain premises.

Any students, who conduct themselves in an anti-social manner towards other students or staff, may be asked to leave immediately. We reserve the right to cancel a student’s enrolment if the inappropriate behaviour persists. This guarantees the safety of other students whilst on our premises.

5. Refund Policy

There are NO credits or refunds available at Brain Education for either missed classes or cancellation of course lessons.

A cooling off period of 7 days applies for new students.

6. Commitment

All fees and charges are payable in advance of the commencement of each course for the full term. If full payment is not received, your enrolment is not guaranteed. The Brain reserves the right to change teachers subject to our discretion. The Brain does not offer free trial lessons.

7. Personal Information

Each student attending the Brain Education is required to submit personal details which are kept confidential. Changes to this information must updated as soon as possible. Inaccurate or incomplete information being provided intentionally may result in the non-acceptance of an enrolment or cancellation of an existing environment.

8. External Examination Results

The Brain requests that its students provide school exam results, HSC results, photographs and ATAR by phone or email. The Brain reserves the right to advertise names, results and photographs for promotional purposes.

9. Use and Disclosure of Personal Information

The student's information provided is used for a variety of purposes including:

- Student administration

- Student surveys

- Promotional campaigns

- The provision of a safe environment for students

Brain will not disclose student's information unless the disclosure is:

- Required by the law

- Authorized by the law

- The parent/guardian has consented in writing to our disclosing of the student's information through the acceptance of the Terms and Conditions of the program for which they have applied

The Brain may utilize third party suppliers from time to time to conduct specialised activities such as mail-outs.

These suppliers act on behalf of Brain and do not facilitate their own commercial agendas whilst processing any personal information. While personal information may be provided to these agents to enable them to perform their agreed tasks, such information remains the property of Brain at all times.

10. Declaration

I declare that the information supplied to Brain in support of this application for enrolment is complete and correct to the best of my understanding and belief. I understand that the purposeful giving of false, misleading or incomplete information may lead to the refusal of acceptance or cancellation of enrolment.

I understand that the fees may increase and accept the liability for the payment of all fees as explained in the Brain brochure or website. I agree that payment must be made to secure enrolment

I agree to abide by the Brain Academic Rules as published and updated on the website from time to time.
